Welcome to MyWonderHero. This website is operated and owned by THE BEST EXCLUSIVE DEALS STORE LTD, trading as MyWonderHero ("We", "Us", or "Our"). By accessing or using our website (www.mywonderhero.com) and purchasing our custom products, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before placing an order. If you do not agree to these terms, you should not use this website. Nothing in these Terms affects your statutory rights as a consumer.

1. General Use & Acceptance

By using this website or placing an order, you represent that you have read, understood, and agreed to these Terms of Service.

We reserve the right to modify, update, or change these terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Changes will apply to orders placed after the change takes effect and will not retroactively affect orders already placed.

2. Custom & Made-to-Order Specifications

All products sold on MyWonderHero are manufactured individually under each specific customer order to fit unique specifications.

By submitting a photograph or personal details of a child for use in a personalized product, you confirm that: (a) you are the parent or legal guardian of the child, or have the express permission of the parent or legal guardian to submit this content; (b) you have the right to use and share the submitted image; and (c) you consent to MyWonderHero processing this image to create your personalized product, as further described in our Privacy Policy.

Once an order is placed, we reserve the right to review its content and to reject or cancel any order that violates our design guidelines, these Terms, or is unlawful. Where we reject or cancel an order, you will receive a full refund.

While we strive to display product colors and materials as accurately as possible, we cannot guarantee that your monitor or mobile screen will perfectly reflect the exact colors of the delivered physical product. This does not affect your rights in respect of manufacturing defects as described in our Refund Policy.

3. Intellectual Property Rights

All content, materials, and intellectual property on this website—including but not limited to text, graphics, logos, designs, custom illustrations, software, and domain names—are the exclusive property of MyWonderHero or our licensors, save for any personal photographs you submit, which remain your property.

Website content is provided solely for personal, non-commercial use. You may not reproduce, copy, modify, distribute, or exploit any part of this website without our express written consent.

4. Pricing and Payments

All prices are subject to change at any time before an order is officially accepted; the price shown to you at checkout is the price you will be charged.

While we make every effort to ensure all pricing on the website is accurate, errors may occasionally occur. If we discover a pricing error on an item you ordered, we will contact you before processing or cancel the order and notify you.

Payment is securely processed and collected in full by our third-party payment gateway providers at the moment you place your order. By completing a transaction, you confirm that the payment method used belongs to you and contains sufficient funds.

We take reasonable care in selecting our third-party payment providers. We are not liable for losses caused by the acts, errors, or omissions of these third-party payment providers, except where such losses are caused by our own negligence or breach of these Terms.

5. Product Availability & Modifications

All products are subject to availability and production capacity. We reserve the right to withdraw, alter, or modify any product or service at any time. If a product you have ordered becomes unavailable, we will notify you and provide a full refund.

6. Limitation of Liability

MyWonderHero acts with reasonable skill and care to provide this website and its services.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the statutory rights implied in your favour by the Consumer Rights Act 2015 (including the right to a product that is as described, of satisfactory quality, and fit for purpose); or (d) any other liability which cannot be excluded or limited under applicable law.

Subject to the above, our total liability for any losses or damages you may suffer as a result of a breach of these Terms is limited to the purchase price of the relevant product. We are not liable for any indirect or consequential losses, such as loss of profits, that were not reasonably foreseeable to both parties at the time your order was placed.

7. Indemnification

You agree to indemnify us against any claims, liabilities, losses, or costs (including reasonable legal fees) arising directly from your breach of these Terms or your infringement of a third party's rights — for example, submitting a photograph you did not have the right to use. This does not affect any of your statutory rights as a consumer.

8. Right to Cancel

Because your product is made to your personal specifications, your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once production has begun. By placing an order, you expressly request that we begin production immediately and acknowledge that you will lose your right to cancel once production starts. Before production begins, you may cancel your order free of charge by contacting support@mywonderhero.com.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
